Rather than being arrested for a 2 star wanted level, having a fine be imposed that increases for every offense committed. You would go to jail if you're unable to pay the fine, or choose not to. A lot of the offenses that cause a 2 star wanted level are pretty minor, so this would be better than having to wait in jail, and having to pay for your items back.
